Welcome to TawkBase.ai, an AI voice agent platform operated by TawkBase, LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the TawkBase platform (the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, please do not use our Service.
You must be at least 18 years old and have the legal authority to represent the organization you are registering. Our Service is designed for business use only.
To access our Service, you must create an account with accurate information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
You agree to use the Service in compliance with all applicable laws and regulations. You may not use the Service to:

iOS pricing reflects Apple App Store pricing, which includes Apple's platform fees. Prices are subject to change with reasonable notice.
Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Your payment method will be charged for the renewal at the same price, unless we notify you otherwise.
If you exceed your plan's included minutes, additional minutes are billed at $0.47 per minute from your prepaid balance. For web and Android users, balance top-ups are processed through Stripe. For iOS users, additional minute balance is managed through the TawkBase web dashboard at https://app.tawkbase.ai/billing.
Except where required by law, all subscription payments are non-refundable. For iOS subscriptions, refund requests must be submitted directly to Apple at https://reportaproblem.apple.com.
Non-payment may result in service suspension or account termination.
All payments are generally non-refundable. However, we may provide refunds at our sole discretion on a case-by-case basis. Refunds are not guaranteed and will be evaluated based on individual circumstances.
TawkBase stores call recordings and associated data for the duration of your active account. You are solely responsible for ensuring your use of our Service complies with applicable data protection and call recording laws in your jurisdiction, including obtaining proper caller consent where required. You acknowledge that callers will interact with an AI voice agent. Disclosure requirements vary by location and are your responsibility to determine and implement.
We retain all rights, title, and interest in the TawkBase platform and all associated intellectual property. You may not copy, modify, distribute, sell, or create derivative works from any part of our Service without explicit written permission.
You may cancel your account at any time through our platform. We reserve the right to suspend or terminate your access immediately if you violate these Terms or engage in fraudulent, abusive, or unlawful behavior. Upon termination, your access to the Service will cease, and stored data will be deleted according to our retention policies.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, secure, or meet your specific requirements.
To the maximum extent permitted by applicable law, TawkBase, LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless TawkBase, LLC and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising from your use of the Service or violation of these Terms.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any legal disputes shall be resolved in the state or federal courts located in Delaware.
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

These terms apply only if you downloaded the TawkBase app from the Apple App Store.
You acknowledge that this Agreement is between you and TawkBase, LLC only, and not with Apple Inc. ("Apple"). TawkBase, LLC, not Apple, is solely responsible for the TawkBase app and its content.
The license granted to you for the TawkBase app is limited to a non-transferable license to use the app on any Apple-branded product that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
TawkBase, LLC is solely responsible for providing maintenance and support services for the TawkBase app. Apple has no obligation to furnish any maintenance or support services.
TawkBase, LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the TawkBase app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the app.
TawkBase, LLC, not Apple, is responsible for addressing any claims relating to the TawkBase app or your possession and/or use of the app, including: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the TawkBase app or your possession and use of the app infringes that third party's intellectual property rights, TawkBase, LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms of agreement when using the TawkBase app.
You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and that, upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
